I have more than 5 years experience as Physical Therapist. I have all the documents from Visa Screen, English Exam, and Credentialing done. The only thing that I don't posses now is the US License. I have been approved by the USCIS in California for H1B but have been turned down by the US Consulate from my home country because of lack of licensure. I was put on hold and was given 221g letter and waited for more than half a year now. What has gone wrong with the application that I have been told that there has been some mistake with me being approved by USCIS for H1B. If anyone knows about this please let me know.

USCIS usually approves H1 petitions for people with tempo license at the very least. It would be hard for you to reverse US embassy decision.

You may want to hire a immigration lawyer.
i believe if you can show enough evidence that you need the Temporary H1B inorder to obtain the license and you wont be employed or settling down,they may grant you one.
Since ur app was rejected once i would suggest moving thro' a lawyer.
Pls also visit the USICS webpage for the info on Temp H1b.You may also want to chat with murthy.com lawyers(free-if u get lucky they'll pick ur Q foe answer.-worth a try).

Where are you from??? I agree that you have to look for an immigration lawyer, because I just spoke with one and he told me that I have to have first my licensure and then apply for the H1B.

I take that u r from India.As i said,there IS a provision to get temp 1 year H1B.Not all are aware of it.U may need to direct your Lawyer to the appropriate info.Pls visit the website forum that i have mentioned previousely.

I had the same situation as yours a few months ago. After receiving my 221g form, I applied for a tourist visa to take the NPTE, went back home, and got my H1B approved instantly. I didn't show the consul my license per se just the copy of my examination result showing I passed and without any questions, she approved my H1b. A piece of advice, you have to act now because you only have a year to accomplish whatever is asked on your 221g. I guess the consulate's policy on H1B approval for PT's has changed. All I know is H1B's won't be approved unless you show them a proof of your license. I know how you must be feeling right now but there's always hope so best of luck to you.

My suggestion is that you take your NPTE exam and passed it then go back to the consulate to show that you passed the test and is eligible to work in the state of CA or apply for a temp license if CA offers one then take NPTE either way you will still need to finish NPTE.
